Terms of Use

Welcome to Phorium ("we," "our," or "us"). These Terms of Use govern your access to and use of the Phorium mobile application and related services. By downloading, installing, or using Phorium, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account or using Phorium as a guest, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old to use Phorium. If you are under 18, you must have parental or guardian consent. By using the app, you represent that you meet these eligibility requirements.

3. Account Registration

You may use Phorium as a guest (limited to 2 analyses per day) or create a free account. When creating an account:

• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your credentials
• You are responsible for all activity under your account
• You must notify us immediately of any unauthorized access

4. Permitted Use

Phorium is designed for personal, non-commercial photo analysis. You may:

• Upload photos you own or have the right to use
• Save and share analysis results for personal use
• Use the analysis for educational or informational purposes

5. Prohibited Use

You may not use Phorium to:

• Upload illegal, harmful, or offensive content
• Upload images of minors in inappropriate contexts
• Attempt to reverse engineer or circumvent usage limits
• Use automated bots or scripts to interact with the service
• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Upload photos of others without their consent

6. Usage Limits

Phorium enforces daily analysis limits based on account type:

• Guest users: 2 analyses per day
• Free registered users: 5 analyses per day
• Pro subscribers: 20 analyses per day

These limits may be adjusted via Firebase Remote Config and are subject to change with notice.

7. In-App Purchases and Subscriptions

Phorium offers optional Pro subscriptions (Weekly, Monthly, Yearly) that provide enhanced features. All purchases are processed through Apple's App Store.

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage or cancel subscriptions through your Apple ID settings
• Refunds are subject to Apple's refund policies
• We do not offer refunds directly — contact Apple for refund requests

8. Advertising

Free users (guest and registered) may see advertisements served by Google AdMob. Subscribing to a Pro plan removes all advertisements. Ads comply with applicable advertising regulations.

9. Intellectual Property

All content, features, and functionality of Phorium (excluding user-uploaded content) are owned by us and protected by intellectual property laws. The AI analysis text is generated using Claude AI by Anthropic.

You retain ownership of photos you upload. By uploading a photo, you grant us a limited license to process it for the purpose of providing the analysis service.

10. AI-Generated Content

Analysis results are generated by AI (Claude by Anthropic) and may not always be accurate. We do not warrant the accuracy, completeness, or reliability of AI-generated analyses. Do not rely on analyses for medical, legal, or safety-critical decisions.

11. Disclaimer of Warranties

Phorium is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Phorium.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. Changes to Terms

We may update these terms at any time. Continued use of Phorium after changes constitutes acceptance of the updated terms. We will notify you of significant changes via the app or email.

15. Termination

We reserve the right to suspend or terminate your account for violations of these terms, without prior notice. You may delete your account at any time through the Profile screen.

16. Governing Law

These terms are governed by applicable law. Any disputes will be resolved through binding arbitration or in the courts of your jurisdiction.
